On November 4, 2010, The George Washington Law Review, the George Washington Law School Intellectual Property Law Program, and the Munich Intellectual Property Law Center presented a symposium celebrating and commemorating the fortieth anniversary of Justice Beryer’s seminal article, The Uneasy Case for Copyright. At the symposium, the panelists discussed ways in which Justice Breyer’s article continues to play a significant role in shaping our understanding of copyright in the context of emerging technologies such as eBooks and online music distribution. On the first day of the symposium, Justice Breyer gave a keynote address reflecting upon his article. That speech forms the basis for this Keynote.
